What is Probate?
Probate is a document issued by the court certifying a Will’s validity and confirming the appointment of an executor (named in the Will) to administer the deceased estate.
If someone dies without leaving a Will, the Grant of Probate can’t be issued. In this case, an executor needs to apply for a Letter of Administration so that they can manage the estate of the person who has passed away.
A Letter of Administration is also necessary if a Will is deemed to be invalid. The Letter of Administration is issued by the Supreme Court in the name of the executor who has applied and this authorises that person to distribute the assets.
